A tradução de ônus da prova: contextos

Dando seguimento ao tema inaugurado na semana passada, selecionamos abaixo algumas exemplos1 em que a expressão burden of proof ocorre naturalmente e apresentamos algumas sugestões de tradução:

1- atribuir/impor o ônus da prova a alguém

  • "In fact, there is really nothing society can do to compensate people who are wrongly convicted. That's one big reason why our criminal justice system puts such a strong burden of proof on the prosecution."
  • "More important, in stark contrast to American standards, British libel law imposes the burden of proof on the author or journalist to prove the truth of an allegation if an action is brought against him."
  • "The relevant statutory provision should be 'read down' so as to impose an evidential burden only on the defendant thus ensuring compatibility with the Convention."2
  • "Leaders of the braceros' campaign say it's unfair that the burden of proof is being placed on these aging men, many of whom still can not read [.]"

2 - [deixar de] atender/cumprir/satisfazer o ônus da prova

  • "But the FTC suffered a setback in June when an administrative law judge ruled that the agency had "failed to meet its burden of proof" for allegations that ScheringPlough Corp. had illegally paid off a generic drug manufacturer to keep the cheaper brand of a popular drug off the market."
  • "In order to meet that burden of proof, Larry Birkhead would like to get a DNA test and would like to have that baby swabbed."
  • "None of this was sufficient to satisfy the state's burden of proof that a murder occurred [.]"

3 - caber o ônus da prova a alguém

  • "Doesn't the burden of proof lie in the other direction?"
  • "When people are accused of crimes and brought before a court of law, the burden of proof is upon the accusers to prove those accusations to a judge or jury beyond a reasonable doubt."
  • "There is no question in my mind that the burden of proof was put on Mechele to prove her innocence."

6 - inverter o ônus da prova

  • "This bill shifts the burden of proof in workers compensation cases for firefighters that contract job-related cancer."
  • "The EU has reversed the burden of proof."
