As colocações de judgment - Parte 1

Na coluna do dia 29/11/2010 (clique aqui), examinamos a diferença entre judgment e sentence. Para complementá-la já abordamos os muitos padrões linguísticos que coocorrem com sentence e, a partir de hoje, passaremos a tratar dos que são formados com judgment.

Os padrões linguísticos (ou colocações) são compostos por unidades lexicais que possuem alto índice de frequência podendo representar sintagmas com conteúdo tão - ou mais - especializado que o conteúdo de termos isolados.

Os exemplos foram retirados do COCA1, salvo quando indicado em contrário.

1. accumulative judgment - "Accumulative judgment [is] a second or additional judgment given against one, who has been convicted, the execution or effect of which is to commence after the first has expired; as, where a man is sentenced to an imprisonment for six months on conviction of larceny, and, afterwards he is convicted of burglary, he may be sentenced to undergo an imprisonment for the latter crime, to commence after the expiration of the first imprisonment; this is called an accumulative judgment.2" Tradução: pena cumulativa

2. agreed judgment (ver judgment by consent, consent judgment)

3. alternative judgment - "On this verdict the court entered a judgment that plaintiff recover from defendant the sum of $3800, with interest. No alternative judgment, as provided by the Practice Act, for the possession or return of the property, was rendered upon the verdict by the District Court.3" Tradução: sentença alternativa

4. civil judgment - "In 1994 the McClintons won a $4 million civil judgment against Sullivan in the wrongful death of their daughter." Tradução: sentença civiel condenatória

5. cognovit judgment - Tradução: sentença de confissão de dívida

6. conditional judgment - "Certain types of disputes, such as neighborhood disturbances, may be effectively addressed by a conditional judgment calling for performance or cessation of acts by a party, conditioned by an award of damages on noncompliance with the order. You may also use a conditional judgment that property must be returned by a specified date, or judgment will enter.4" Tradução: sentença condenatória aplicando sanções alternativas pelo descumprimento do réu

7. confession of judgment - (ver cognovit judgment) "A cognovit note allows the "contracting parties to preclude factfinding by agreeing to confession of judgment.") The debtor authorizes the attorney (usually for the creditor) to enter judgment against the debtor if the debt is not paid on time. The debtor not only waives notice and a hearing but also waives" every defense which the maker of the note may otherwise have. It likewise cuts off all rights of appeal from any judgment taken on it." Tradução: confissão de dívida

8. consent judgment (ver agreed judgment, judgment by consent) - "In 1995, after the company failed to take safety steps it had promised to make to settle prior charges, a state superior court ordered TRW to pay $1.7 million-the largest corporate criminal consent judgment in state history." Tradução: acordo judicial, acordo homologado pelo juiz

9. contradictory judgment - Tradução: sentença proferida após ambas as partes terem tido direito ao contraditório

10. declaratory judgment - "In 1996, SeaRiver Maritime brought suit in federal district court in Houston, Texas, seeking a declaratory judgment that section 5007 of OPA is unconstitutional." Tradução: sentença declaratória
